Terms of Service

1. Introduction
Welcome to Washaaa. These Terms of Service (“Terms”) govern your use of the Washaaa mobile application and platform (the “Service”), which connects customers seeking car wash services with independent washers who provide those services.
By creating an account and using Washaaa, you agree to be bound by these Terms. If you do not agree, please do not use our Service.
2. Who Can Use Washaaa
2.1 Eligibility
To use Washaaa, you must:
- Be at least 18 years of age
- Have a valid phone number or email address
- Be capable of entering into a legally binding agreement
- Not have been previously banned or removed from the platform
2.2 Account Registration
You are responsible for:
- Providing accurate and up-to-date information during registration
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
You must notify us immediately at info@washaaa.com if you suspect unauthorized use of your account.
3. The Two Roles on Washaaa
3.1 Customers
Customers are individuals who use the app to:
- Register their vehicles and save service locations
- Place car wash orders
- Track the washer's arrival in real-time
- Pay for services through the app
- Review and validate completed orders
3.2 Washers
Washers are independent service providers who:
- Register as service providers on the platform
- Receive and accept nearby order requests
- Travel to the customer's vehicle location
- Perform the car wash service
- Document the service with before and after photos
- Earn income through the platform
Washers are independent contractors, not employees of Washaaa. Washaaa provides the technology platform that connects washers with customers but does not direct or control the manner in which services are performed.
4. The Order Process
- Customer places an order by selecting their registered car and service location.
- Washaaa notifies nearby washers of the available order.
- A washer accepts the order — the customer is notified immediately.
- The washer travels to the customer's vehicle (customer can track in real-time).
- The washer documents the vehicle with before photos.
- The car wash is performed.
- The washer takes after photos to document the completed service.
- The customer validates the order to confirm satisfactory completion.
- Payment is processed and the washer's earnings are credited.
5. Pricing and Payments
5.1 Service Pricing
Prices are determined by vehicle size:
- Small car: 40 MAD
- Medium car: 50 MAD (default)
- Large car: 60 MAD
Prices are shown clearly before you confirm your order.
5.2 Payment Method
Payments are processed securely through PayPal. By placing an order, you authorize Washaaa to charge the displayed amount to your PayPal account.
5.3 Platform Commission
Washaaa deducts a 15% platform commission from each order. Washers receive 85% of the order value.
5.4 Washer Earnings & Holding Period
After a customer validates an order:
- Washer earnings are placed in a 24-hour holding period to allow for dispute resolution.
- After 24 hours with no dispute, funds become available for withdrawal.
5.5 Withdrawals
Washers may withdraw available funds with a minimum withdrawal of 10 MAD. Supported withdrawal methods:
- PayPal
- Bank transfer
- Cash (where available)
5.6 Refunds
Refunds may be issued in the following cases:
- The washer did not show up
- The service was not performed as agreed
- A valid dispute is raised and resolved in the customer's favor
Refund requests must be submitted within 48 hours of the order's scheduled completion by contacting info@washaaa.com.
6. Cancellations
6.1 Customer Cancellations
- Customers may cancel an order before a washer has been assigned at no charge.
- Cancellations after a washer has accepted and is en route may be subject to a cancellation review.
6.2 Washer Cancellations
- Washers who repeatedly cancel accepted orders may have their account suspended or removed from the platform.
7. Customer Responsibilities
As a customer, you agree to:
- Ensure your vehicle is accessible at the specified location at the time of the order
- Provide accurate vehicle and location information
- Treat washers with respect
- Validate the order honestly once you have inspected the completed work
- Not request services that are outside the scope of the car wash (e.g., interior detailing unless offered)
8. Washer Responsibilities
As a washer, you agree to:
- Provide services professionally and to a reasonable standard of quality
- Arrive at the customer's location within a reasonable time after accepting the order
- Take accurate before and after photos of every vehicle
- Treat customers and their vehicles with respect and care
- Not damage customer vehicles. You are liable for any damage caused during the service
- Keep your profile information and location up-to-date
- Comply with all applicable local laws and regulations
9. Photos and Documentation
- Before and after photos are mandatory for every order.
- Photos are used for quality assurance and dispute resolution.
- By submitting photos through the app, you grant Washaaa a non-exclusive license to use those photos internally for dispute resolution and service quality purposes.
- Washaaa will not use service photos in public marketing without explicit consent.
10. Real-Time Location Tracking
- Washers acknowledge that their real-time GPS location will be shared with the assigned customer while an order is active.
- Customers acknowledge that their saved service location will be shared with the assigned washer.
- Location sharing for washers stops when an order is completed or when the washer goes offline.
11. In-App Chat
The in-app chat feature is provided to allow customers and washers to communicate about active orders. You agree not to use the chat to:
- Share personal contact information to bypass the platform
- Send abusive, threatening, or offensive messages
- Engage in any fraudulent or illegal communication
Washaaa reserves the right to review chat messages in the context of dispute resolution.
12. Ratings and Reviews
After order completion, customers may rate and review washers. You agree that:
- Ratings must be honest and reflect your genuine experience
- Reviews may not contain offensive, discriminatory, or false content
- Washaaa reserves the right to remove reviews that violate these Terms
13. Prohibited Conduct
You agree not to:
- Use the platform for any illegal purpose
- Create fake accounts or impersonate another person
- Manipulate ratings or reviews
- Attempt to take transactions off-platform to avoid fees
- Interfere with the platform's technical operation
- Harass, threaten, or discriminate against other users
- Use the app while under the influence of alcohol or drugs (for Washers)
Violation of these rules may result in immediate account suspension or permanent ban.
14. Account Suspension and Termination
14.1 By You
You may delete your account at any time through the app settings. Upon deletion:
- Your personal identifiers (email, phone) are anonymized immediately
- Your historical order and transaction data is retained for legal and compliance purposes
14.2 By Washaaa
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Repeatedly cancel orders (Washers)
- Receive consistently poor ratings without improvement
- Provide false information during registration
15. Intellectual Property
All content, branding, logos, and technology in the Washaaa app are the property of Washaaa. You may not copy, reproduce, or distribute any part of our platform without written permission.
16. Disclaimer of Warranties
Washaaa provides its platform “as is” and “as available”. We do not guarantee:
- Uninterrupted or error-free service
- That washers will always be available in your area
- The quality of any individual washer's work
Washaaa is a technology platform, not a car wash service provider. We are not responsible for the actions or omissions of washers.
17. Limitation of Liability
To the maximum extent permitted by law, Washaaa shall not be liable for:
- Damage to your vehicle caused by a washer
- Loss of data or service interruptions
- Indirect, incidental, or consequential damages arising from your use of the platform
In all cases, Washaaa's total liability to you shall not exceed the amount paid by you for the specific order giving rise to the claim.
18. Dispute Resolution
18.1 Between Users
Disputes between customers and washers should first be reported through the app. Washaaa will review submitted evidence (photos, chat logs, order data) and make a fair determination.
18.2 With Washaaa
Any dispute with Washaaa that cannot be resolved informally shall be submitted to binding arbitration or resolved in the courts of the jurisdiction where Washaaa operates.
19. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes through the app or via email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
20. Governing Law
These Terms are governed by the laws of the jurisdiction in which Washaaa operates. Any legal proceedings shall be conducted in that jurisdiction.
